All the allegations leveled against him have been rejected outright.
This FIR was lodged by senior police officer Dr. Sunita Tiwari FSL officer through her influence in connivance with the police officers due to her posting in the local police.
It is very important to clarify that during the second wave of Covid-19 in the months of April and May, when there was lockdown everywhere and there was chaos, Dr. Rajeev Jain, a pediatrician, was the only person in the city to serve the suffering humanity. COVID-19 Child Center was started.
In which about 200 children were treated in the months of April and May 2021, out of which not a single Covid-19 positive child died, but another girl who had Covid-19 like symptoms was alive under their treatment for the last 13 years. The name was Khushi Tiwari, the girl was already mentally weak, she was suffering from congenital rubella syndrome, hole in the heart, partial blindness, and lung infection, which Dr. Rajeev Jain diagnosed 13 years ago in 2008. His life was saved in other private children's hospitals. Even today all the hospital staff feel sad and sympathetic towards his death.
Child Khushi Tiwari was brought to Star Hospital at 11:00 pm in a very critical condition during the second wave of Covid 19. At the time of admission, her heart was not functioning, blood pressure was extremely low, there was severe infection in the lungs, LDH And D dimer were more than normal, all these circumstances demonstrate complications like Covid-19. In such a situation, during treatment, the child got choked in the windpipe by feeding water despite the refusal of the parents and the hospital staff. had died.
All life saving efforts were made by Dr. Rajeev Jain, but the girl's life could not be saved.
The girl's mother, despite being an FSL officer, had taken the body away without post-mortem and 10 days after the death, a complaint was filed by her alleging negligence, despite the complainant Mrs. Sunita Tiwari being a senior police officer and FSL officer. Due to this, the police administration, supporting its officer, had registered a case against Dr. Rajiv Jain. Whereas in the investigation conducted by the Chief Medical and Health Officer, Jabalpur, such a report was received that the treatment is being done in the right direction.
Madhya Pradesh High Court, after hearing the arguments of both the parties on the entire issue and after careful consideration, has decided that no such allegation and FIR is made against Dr. Rajeev Jain and he has tested positive for Covid-19 for the second time. During the wave, as much effort as possible was made in the service of humanity.
In such a situation, all the charges against him have been dropped and all types of processes going on related to this complaint have been completely stopped.
It has also been said by the Honorable High Court that death is a bitter truth which should be accepted by everyone, if cases like this continue to be filed against doctors due to complaints of death, then in the future doctors will never be able to treat serious patients. And will always be afraid of giving them treatment.
The Honorable High Court has today taken a historic decision to motivate doctors to provide treatment to serious patients to serve the suffering humanity.
It is very important to mention that this case has been argued by Senior Advocate Mr. Anil Khare, Advocate Satyendra Jain and Advocate Amitabh Bharti.
