Later, after getting bail from Patna High Court, he was again planning to contribute in Buxar, but the department took prompt action in time and suspended the fugitive Excise Superintendent Dilip Pathak. While holding such a high position, he was smuggling liquor for 8 years. He was involved in liquor smuggling ever since the liquor ban law was passed in Bihar.

It can be said that those who had the responsibility of effectively implementing the liquor ban law were the ones who smuggled liquor. They used to bring liquor from Uttar Pradesh and sell it in Bihar, a state with liquor ban. In fact, on 21 June 2024, the police of Industrial Police Station caught three vehicles Scorpio, Indica, Honda City Car loaded with liquor. After which a case was registered. During the investigation, the police arrested Manish alias Marandi, a big liquor smuggler from Patna, from Buxar. Pictures and vehicle numbers of liquor laden vehicles were WhatsApped from Manish's mobile to constable Sheshnath Yadav posted at the excise check post.

After which the checkpost of the excise department left the vehicle without any investigation, but the Buxar police, who were checking the vehicles ahead, caught him. When the constable's phone was seized and investigated, another constable of the excise department, Ramshankar Singh, along with 8 people were caught by the police. After which, evidence of collusion between the liquor mafia and Excise Superintendent Dilip Pathak and transaction of huge amount was found from the constable's mobile. After which the department has suspended Excise Superintendent Dilip Pathak with immediate effect. After this action against the liquor mafia, there is panic among the police personnel and officers.
When people came to know that Excise Superintendent Dilip Pathak has been doing this business since the prohibition of liquor was implemented in Bihar, they were surprised to hear. There is a discussion among the people that the one on whose shoulders it is to implement this law has done the work of breaking the law. Dilip Pathak used to flag off vehicles laden with liquor from different borders of Buxar-UP since 2016 and get them across the border. In return for which a huge amount used to reach the Excise Superintendent.
In Kaimur district of Bihar, a case of drinking alcohol by a sub-inspector, two watchmen and an outsider while sitting in the police station came to light. All four have been arrested and action is being taken to send them to jail. In this case also it was seen that those on whose shoulders the responsibility of catching the liquor smugglers and to properly implement the liquor ban has been given are themselves breaking this law openly.
