Damoh, the prosecution case in brief is as follows that on 30.10.2020, after receiving information from the informer along with Rajendra Munshi and three other policemen from Police Station Kotwali, they went from Kumhari towards Gasabad on Cash Tiraha from where three in a four-wheeler Persons Goparanjan Patnaik, Somnath Patnaik and Leetu Sahu, resident of Orissa, were found sitting in the car. Goparanjan was driving the car and two other persons, one of whom was carrying something in a black bag in his lap and the other in a plastic bag at the back. All three persons were suspected to be from Orissa. Due to which his bag and packet were searched in which 3 kg ganja was found and on enquiry, he told that he had sold 10 kg ganja to Shyamlal. If there is no license during interrogation, the offense against the accused is Section 8/20 NDPS. Since the crime was found punishable under the Act, it was registered and taken up for investigation. During investigation, 1.5 kg ganja was seized from accused Shyamlal by Sub-Inspector Prashita Kurmi.

The accused were punished by the court on the basis of the evidence presented in the court and the arguments presented by the prosecution.

The prosecution was represented by Special Public Prosecution Anshul Mishra and Satish Kapasya under the guidance of District Public Prosecution Officer in-charge Kailash Chand Patail.
The case was investigated by the then police station in-charge Gasabad Sandeep Dixit. During the Ganja proceedings, there was a dispute between the Kotwali police station and the villagers.
Accused: Shyamlal Patail - Village Khairi, Somnath Patnaik, Leetu Sahu - absconding, Goparnjan Patnaik - absconding.
All three residents of Sambalpur Orissa, accused Shyamlal and Somnath were punished with rigorous imprisonment for a term of 5 years and a fine of Rs 20000 each under Section 20(B)(ii)(B) of the NDPS Act.
