Ram Mandir Donation Controversy
FIR named against 8 individuals under BNS sections in SIT's preliminary report
There is currently a significant stir in Uttar Pradesh politics regarding the controversy over donations to the Ayodhya Ram Mandir. A Special Investigation Team (SIT), constituted on the instructions of Chief Minister Yogi Adityanath, has submitted its preliminary report to the government. Although the final investigation is pending and no accused has yet been convicted by a court, the preliminary report points to several serious irregularities, triggering heightened activity at both administrative and political levels. The SIT's preliminary probe reportedly uncovered numerous discrepancies in the management and record-keeping of donation funds. According to the report, indications of irregularities were found regarding the accounting of cash donations, records of gold and silver offerings, and procurement processes. The investigation team questioned approximately 150 individuals and identified the roles of about 25 people as suspicious, suggesting that further action against them is likely. Some reports indicate that investigative agencies have focused specifically on the roles of two office-bearers associated with the trust, and their actions are being examined separately; however, these allegations will only be conclusively confirmed once the investigation concludes. Regarding FIRs and arrests: based on the SIT's preliminary report, the Uttar Pradesh Police have registered an FIR against eight individuals. Charges include theft, criminal breach of trust, fraud, and criminal conspiracy. The FIR concerning the Ram Mandir donation embezzlement case has been registered under several serious sections of the Bharatiya Nyaya Sanhita (BNS). The police have booked eight named accused persons along with other unidentified individuals. BNS Section 306 (Theft by a clerk or servant): This section applies when an employee, servant, or person entrusted with responsibility commits theft; in this case, several accused were involved in the counting and management of donation funds and valuables. If proven, the offense carries a penalty of up to seven years in prison and a fine. BNS Section 316(5) (Criminal breach of trust): This section applies when property or funds entrusted to a person are misappropriated or embezzled; similar allegations have been raised regarding temple offerings and donation funds. BNS Section 317(4) (Breach of trust by a person in a position of special trust): This section applies to those... This applies to individuals holding positions in an institution or agency—or roles involving specific responsibilities—who misuse funds or assets. It entails relatively severe penalties because the offense involves a breach of trust. Regarding BNS Section 61 (Criminal Conspiracy), the police have alleged that since the act was planned and executed collectively by multiple individuals, this section applies to them as well; under this provision, all co-accused can be held equally liable. Key individuals named in the FIR include Ramashankar Yadav (alias Tinnu Yadav), Anukalp Mishra, Lavkush Mishra, Avinash Shukla, Manish Yadav, Ramashankar Mishra, Subhash Srivastava, and Karunesh Pandey. Most of these individuals were reportedly involved in the counting and management of cash donations, gold, silver, and other valuables. It is important to note that the matter is currently under investigation; the filing of an FIR marks the beginning of allegations, not a final conviction. The court holds the ultimate authority to determine guilt, and the full picture will emerge only after the SIT submits its final report and the judicial process concludes. According to media reports, all eight accused were arrested within hours of the FIR being filed. Chief Minister Yogi Adityanath had already made it clear that the guilty would not be spared at any cost and that the investigation would be conducted with complete transparency. The government claims to have granted full autonomy to the SIT and has instructed the administration to take strict action. Sources indicate that the SIT has recommended measures such as restructuring the trust to bring about comprehensive operational improvements and enhance transparency, thereby preventing a recurrence of such incidents in the future. Based on the preliminary report, action is likely to be taken against individuals at various levels, including staff involved in donation collection and counting, contractual workers handling cash, officials negligent in record-keeping, trust office-bearers whose roles are under scrutiny, and local officials responsible for lapses in administrative oversight. However, the final determination of liability and legal action will depend on the completion of the investigation and the court's verdict. Samajwadi Party chief Akhilesh Yadav has consistently alleged that action is being taken only against low-level individuals while powerful and influential figures are being shielded. He stated that the filing of the FIR... ...is not enough; rather, the full truth must be revealed, and action taken against all those responsible. The opposition demands that the complete audit of the donation funds be made public and that an independent inquiry into the trust's financial affairs be conducted.
They also call for an investigation into the role of high-ranking individuals and insist that the probe be carried out under the supervision of the Supreme Court. The Bharatiya Janata Party and the state government maintain that they have demonstrated transparency by initiating an inquiry themselves and that action will be taken against anyone found guilty, regardless of their position or influence. The government claims that the opposition is attempting to derive political mileage from this issue, whereas the administration is proceeding in accordance with the law. The Ram Mandir is not merely a religious site but a highly sensitive issue in both Uttar Pradesh and national politics; consequently, the allegations of irregularities regarding donations have It has heated up the political atmosphere.
