Accused Sanjay Roy refuses to undergo narco test in court
CBI, which is investigating the rape and murder of Doctor Bitiya in Kolkata's RG Kar Medical College Hospital, is in trouble. More than a month has passed since this incident. Doctor Bitiya was brutally murdered while on duty. There is an atmosphere of anger in the whole country regarding this. Despite this, CBI has not got any major success in the case yet. It has definitely arrested the college principal on corruption charges.
Within some time of this incident, Kolkata Police arrested the accused named Sanjay Roy. But, in view of the questions raised on the investigation of Kolkata Police and the anger of the doctors, the investigation of the case was handed over to CBI. Meanwhile, CBI is continuously trying to extract the truth from Sanjay Roy. To get to the bottom of the matter and to know the possibility of someone else being involved in this incident, CBI wanted to get Sanjay Roy's narco test done. For this, it reached the Siyadh court. But, in the court, Sanjay Roy refused to give consent for the narco test.
Supreme Court's decision became a hurdle
Actually, according to a 2010 Supreme Court decision, narco test of any accused cannot be done without his consent. The result of the narco test can be presented as evidence in the court but the court does not accept it as the only evidence. It has to be matched with the circumstances of the incident.
The CBI had told the court that the narco test would help in confirming Sanjay Roy's statements. The CBI says that it wanted to get the narco test done so that Roy's statements could be cross checked. In this test, sodium pentothal is injected into the body of the accused. Due to this effect, the accused almost comes into a state of sleep and in such a situation, the possibility of him lying is almost eliminated.
