Damoh, Court Special Judge Prevention of Corruption Act, Smt. Dr. Aarti Shukla Pandey District Damoh court found the accused Kamlesh Kumar Raikwar, the then Secretary Agriculture Produce Market, Damoh guilty and sentenced him to 03 years rigorous imprisonment under Section 7 of the Prevention of Corruption Act and Section 13(1) )(d) Under Section 13(2), he was sentenced to 04 years rigorous imprisonment and a total fine of Rs 8000.

The prosecution was represented by Special Public Prosecutor Anant Singh Thakur under the guidance of District Prosecution Officer in-charge Kailash Chand Patel.

It was told that on 19 December 2017, applicant Rajesh Vyas, father late. Sitaram Vyas, aged 50 years, resident of Sagar Naka, District Damoh (MP), had submitted a complaint letter against the non-applicant Kamlesh Kumar Raikwar, the then Secretary Agriculture Produce Market, Damoh, to the Superintendent of Police, Lokayukta Sagar, regarding the demand for bribe, that, the cleaning work done by the applicant The bill and security deposit and the bill of Chief Minister Farmers Restaurant are to be paid. In relation to which a bribe is being demanded in lieu of payment received from accused Kamlesh Kumar Raikwar, Secretary Agriculture Produce Market, Damoh. The applicant does not want to give bribe to the non-applicant, but wants to get him caught red-handed taking bribe. The conversation related to bribe demand was recorded for verification of the complaint submitted. After the above verification, the trap was organized on 03 January 2018. During the trap operation, a bribe amount of Rs 10,000 was recovered from the accused in the official residence of the Lokayukta police. After all the proceedings and deliberations, the charge sheet was presented before the Honorable Special Court for Prevention of Corruption Act, Damoh. After the case came to the court, after agreeing with the documentary evidence and oral evidence and the arguments presented by the prosecution, in the decision passed on 28 October 2023, the Honorable Court found the accused Kamlesh Kumar Raikwar, the then Secretary Agriculture Produce Market Damoh, guilty under Section 7 of the Prevention of Corruption Act. Under section 13(1)(d) read with 13(2), he was sentenced to 04 years rigorous imprisonment and a total fine of Rs 8000.
