Convict Sanjay Roy sentenced to life imprisonment
The sentence was announced on Monday in the RG Kar case of Kolkata, the capital of West Bengal. The court pronounced its verdict at 2.45 pm and sentenced the convicted Sanjay Roy to life imprisonment. The Sealdah court also imposed a fine of Rs 50,000 on Sanjay Roy. Sealdah Court Judge Anirban Das said that this is not a rarest of rare case. The victim's family should be given Rs 10 lakh compensation and an additional Rs 7 lakh for her death.
Earlier, Sanjay Roy was convicted by a Kolkata court in the case of rape and murder of a female trainee doctor at the government RG Kar Medical College and Hospital. Under the sections under which Roy has been convicted, he can be sentenced to a minimum of life imprisonment, while the maximum punishment is death.
Before pronouncing the verdict, the convict was produced in the court. During this, Sanjay Roy told the court that I am being framed, I have not committed any crime. On this, the CBI said that this is a heinous crime. It had shaken the whole country. The CBI advocate told the court that we request the harshest punishment to maintain the faith of the people in the society. In the case, the victim's parents have demanded death penalty for the culprit.
In his argument, Sanjay Roy's lawyer said that the culprit should be given some other punishment instead of hanging. Even if it is a rarest of rare case, there should be scope for reform. The court will have to show why the culprit is not worth reforming or rehabilitation. The public prosecutor will have to present evidence and give reasons why the person is not worth reforming and should be completely eliminated from society.
I am not satisfied with the punishment - Mamata
On the life imprisonment sentence to Sanjay Roy, convicted in the rape and murder case of a trainee doctor of RG Kar Hospital, West Bengal Chief Minister Mamata Banerjee said that she is not satisfied with the court's decision. Mamata Banerjee said that we all had demanded the death penalty but the court has given life imprisonment.
What is the matter?
Additional District and Sessions Judge Anirban Das of Sealdah court on Saturday convicted Sanjay Roy of raping and murdering the postgraduate trainee female doctor at the hospital on August 9 last year. The heinous crime had sparked outrage across the country and protests continued for a long time.
Arrested on August 10, 2024
Sanjay was arrested on August 10, 2024, a day after the body of the 31-year-old doctor was found in the seminar room of RG Kar Hospital. The judge has convicted him under sections 64, 66 and 103 (1) of the Indian Justice Code (BNS).
Provision of punishment
Section 64 (rape) of the BNS provides for a minimum sentence of 10 years, which can extend to life imprisonment. Section 66 provides for a minimum sentence of 20 years and can extend to life imprisonment. Under Section 103(1) (murder) of the BNS, the guilty is punished with death or life imprisonment.
Investigation was transferred to CBI
The Calcutta High Court had transferred the investigation of the case from the Kolkata Police to the Central Bureau of Investigation (CBI). The judge had said that Roy's statement would be heard in the afternoon and the sentence would be pronounced after that. At the time of the verdict on Saturday, Roy had claimed in the court that he had been framed.
